Understanding Solar Power Project Delays and PPA Extensions in Karnataka

Background of the Solar Power Initiative

A specialized corporate entity was established to execute a renewable energy venture in the Tumkur district located within the State of Karnataka. The firm submitted an official proposal aimed at expanding green energy generation by setting up a photovoltaic facility with a generation capacity of two megawatts in Shyasamaru village.

The regulatory body responsible for renewable energy promotion in the region reviewed the application and granted formal approval. Following this clearance, an official Letter of Award was dispatched to the developers to officially commence the renewable energy initiative.

Execution of the Power Purchase Agreement

With the initial approvals secured, formal paperwork progressed. A comprehensive Power Purchase Agreement was officially signed between the developer and the primary utility provider for the Bangalore region on July 2, 2015.

According to the agreed terms outlined within this contract, the scheduled commercial operation date for the facility was established within eighteen months from the effective date. This meant the project was required to become fully operational by January 1, 2017.

Challenges and Force Majeure Events

During the implementation phase, the developers encountered severe obstacles that hindered timely construction and synchronization. Citing unforeseen circumstances categorized as force majeure events, the operating entity struggled to meet the initial deadline.

These disruptions prevented the facility from achieving commercial viability by the targeted date. Consequently, the developers approached the utility provider to seek relief and formal acknowledgment of the delays caused by external factors beyond their control.

Extension of Time and Final Commissioning

Recognizing the validity of the disruptions and the overall circumstances surrounding the development, the utility provider reviewed the case. An official memorandum was issued on June 16, 2017, granting an extension of time until July 1, 2017.

Despite this initial extension, further adjustments were accommodated, and the renewable energy installation achieved final commissioning a few weeks later on August 31, 2017. To formalize this milestone, the state transmission corporation officially issued a completion certificate on October 19, 2017, validating that the green energy facility was fully functional.
