The underlying legal challenge stems from a common order issued on December 24, 2025, by the Maharashtra Electricity Regulatory Commission. That regulatory decision addressed two consolidated cases involving both entities under a longstanding Power Purchase Agreement originally executed on February 23, 2010. Official documents show that MSEDCL had initially contested specific invoices issued by JSW Energy for the period spanning November 1, 2022, through June 30, 2025.

Concurrently, the second respondent, JSW Energy Limited, had initiated separate proceedings to seek the formal enforcement of the 2010 PPA terms. The regulatory commission subsequently evaluated both matters together, culminating in the December 2025 joint ruling. MSEDCL responded to that joint outcome by filing an appeal before the tribunal, which has now led to the current request for withdrawal and redirection back to the commission.

During the recent hearing, legal representatives for the state utility formally requested permission to withdraw the appeal while reserving the right to file a formal review petition. Furthermore, the appellant sought liberty to approach the tribunal again at a later date, contingent upon the ultimate outcome of the upcoming review proceedings. Judicial authorities are currently reviewing the procedural request to determine the appropriate legal pathway for both parties.

Industry analysts note that this procedural shift highlights the complex regulatory frameworks governing long-term energy contracts in the region. The resolution of billing disputes between major distribution utilities and independent power producers remains critical for maintaining financial stability within the power sector.
