Background of the Legal Dispute
Legal proceedings under consumer protection laws often involve multiple stages of appeals where corporate entities and individual consumers present their respective arguments. A notable case in this regard involves appellate challenges filed under Section 15 of the Consumer Protection Act, 1986. These legal actions stem from an initial judgment and order delivered by the District Consumer Disputes Redressal Forum in Haridwar.
The Originating Complaint
The foundational dispute originated from consumer complaint number 63 of 2018, which was filed by Sh. Pradeep Agarwal. The original complaint named Mahindra and Mahindra Ltd. along with another entity as the opposing parties. The consumer sought redressal for grievances related to the purchase or service of a vehicle, prompting an extensive review of the commercial transaction by the district adjudicating body.
The District Forum Decision
Upon reviewing the merits of the initial complaint, the district adjudicating forum ruled in favor of the consumer. The formal judgment and order, dated July 16, 2019, found the opposite parties liable and instructed them to pay a substantial financial sum of Rs. 8,97,885 to the complainant. This ruling set the stage for subsequent challenges in higher appellate forums.
Filing of the Appeals
Dissatisfied with the outcome of the district forum, the involved corporate entities pursued higher legal remedies. Two distinct appeals were formally registered under Section 15 of the Consumer Protection Act. The first appeal, designated as SC/5/A/314/2019, was brought forward by Dehradun Premier Motors Private Limited. Simultaneously, a parallel appeal registered as SC/5/A/369/2019 was filed by Mahindra and Mahindra Limited against the original complainant and another respondent.
