Operational Flow and Supply Chain
Once the compression phase concludes, the resulting compressed natural gas is routinely distributed to major oil marketing partners. While a significant portion of these transfers involves standard cylinder deliveries accompanied by the appropriate payment of central excise duty, a separate operational channel formed the basis of the ongoing regulatory dispute.
Nature of the Excise Duty Dispute
The disagreement specifically concerns shipments dispatched in cascades to various client sites where specialized pressure reducing skids had been established. At these customer locations, the compressed natural gas undergoes a controlled decompression procedure to supply usable natural gas. The enterprise responsible for the supply did not remit central excise duty for these specific cascade movements, operating under the assumption that these operations fell outside the standard taxation framework.
Regulatory Intervention and Show Cause Notices
Tax authorities examined these clearance practices and concluded that excise liabilities applied to the gas supplied through the cascade and pressure reducing skid arrangement. Consequently, officials issued a series of periodical show cause notices to address the unpaid amounts. These administrative proceedings ultimately resulted in a substantial financial demand totaling more than eight crore rupees, accompanied by mandatory interest charges and administrative penalties directed at both the primary corporate entity and its chief executive officer.
Appellate Review and Tribunal Proceedings
Following the unfavorable initial determinations, the corporate leadership and the executive officer challenged the rulings before the appellate commissioner. Unfortunately for the appellants, the reviewing authority upheld the financial demands in their entirety. Seeking further relief, the affected parties escalated the matter to the tribunal to contest the validity of the excise assessments and associated penalties.
