State Consumer Disputes Redressal Commission Reviews Auto Deficiency Appeal in Howrah

On August 18, 2026, the state consumer dispute mechanism examined an ongoing legal appeal concerning vehicle repair deficiencies and consumer compensation in Howrah. Presided over by Hon’ble Mr. Santanu Saha, Member, the proceedings focused on the adequacy of relief originally granted under the Consumer Protection Act, 1986.

The genesis of the legal dispute traces back to a consumer complaint filed by Dinesh Kumar Shaw against the sales manager and representatives of M/S. Auto Hi-Link. According to official reports, the initial grievance contested the quality of automotive services and subsequent vehicle malfunctions following a purchase.

Official data shows that the case initially came before the Learned District Consumer Disputes Redressal Forum in Howrah. On March 27, 2017, the District Forum issued a judgment in Complaint Case No. HDF/18/2016, ruling in favor of the complainant against opposite parties jointly and severally.

The district-level directive mandated the dealership to repair the disputed vehicle to the complete satisfaction of the consumer. Furthermore, the order required the respondents to deliver the fully serviced automobile back to the owner within a strict thirty-day window.

In addition to the repair mandate, the 2017 ruling awarded the consumer Rs. 10,000 as compensation for mental agony and harassment. The forum also ordered the opposing parties to pay Rs. 5,000 to cover the litigation costs incurred during the initial proceedings.

To enforce compliance, the original judgment incorporated stringent default consequences for any operational delays. Official records indicate the forum imposed a penalty of Rs. 100 per day alongside an interest rate of eight percent per annum for non-compliance.

The current appellate review evaluates whether the original remedies sufficiently address the grievances suffered by the consumer. Legal analysts note that such appellate scrutinies play a crucial role in maintaining accountability within the automotive retail and service sector.

Consumers and industry stakeholders alike closely monitor these judicial reviews to understand evolving standards of service liability. Legal experts suggest the final outcome may reinforce judicial expectations regarding timely vehicle repairs and fair compensation practices.

As the legal process advances, observers await the final directives from the appellate authority regarding the enforcement of the original district forum orders. Future hearings will determine if additional penalties or altered compensations are warranted under the law.
